The US politician Newt Gingrich, who is looking to secure his party's nomination as the Republican presidential candidate, is to be sued by the band Survivor for using their hit song during campaigning rallies.

Eye of the Tiger, which was used by Sylvester Stallone in the hit boxing movie Rocky III, has been used by Gingrich to rouse his supporters as well as sending out a statement to his political counterparts that he is "rising up to the challenge of our rival".

The company Rude Music Inc, which is owned by the band's frontman Frankie Sullivan, filed the suit in Illinois' federal court on the grounds that it is being used without their official approval.

Sullivan and the rest of his bandmates want an injunction to be slapped on Gingrich to prevent him from further using the classic tune, which has since gone on to become a part of the Rocky mythology.

"The question over the legality of playing music on the stump is one that hasn't yet been tested in the courts," wrote Eriq Gardner for Billboard.

"Most political campaigns purchase blanket licenses from performance rights organisations such as ASCAP."
